Conditions of Sale

Terms and Conditions

All property offered and sold through Se-LECTABLES Auction House, (hereafter referred to as the "Auction House") shall be offered and sold on the terms and conditions set forth in these Conditions of Sale. By participating in any sale, you acknowledge that you are bound by these terms and conditions. The Auction House has made every effort to catalog and accurately describe property to be sold. The Auction House, however, assumes no risk, liability or responsibility for the identification or authenticity or authorship, or weight, count, or measure of any property identified in its catalog or lists of sale. This shall include, among others, the identity of the creator, the period, culture, source of origin, as the case may be, with which the creation of any property that is identified in any publication. As for authentication papers, the issuing party shall be solely responsible for the contents of papers so issued.

ALL PROPERTY IS SOLD "AS IS." THE AUCTION HOUSE MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND WITH RESPECT TO ANY PROPERTY OFFERED FOR SALE. THE AUCTION HOUSE MAKES NO WARRANTY OF TITLE, WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR ANY OTHER WARRANTY OR REPRESENTATION OF ANY KIND OR NATURE WITH RESPECT TO THE PROPERTY. In no event shall the Auction House be responsible for the correctness, nor deemed to have made any representation or warranty of description, genuineness, attribution, provenance or condition of the property and no statement by anyone or in the catalog, in any advertisement, or which is made at the sale, in the bill of sale or invoice, or elsewhere, shall be deemed such a warranty or representation or an assumption of liability. All bidders acknowledge their right to have made or requested full inspection of any and all properties prior to sale and agree to be charged with all matters such inspection may have disclosed or indicated.

The Auction House reserves the right to withdraw any property at any time before the fall of the hammer at its sole and exclusive discretion.

Bidding Information

Upon the fall of the hammer or at the end of a timed auction, title to any offered lot or article will immediately pass to the highest bidder as determined at the exclusive discretion of the auctioneer or Auction House. Such bidder thereupon assumes full risk and responsibility for the property sold, agrees to sign any requested confirmation of purchase, and agrees to pay the full purchase price therefore or such part upon such terms as the Auction House may require. All property shall be paid for and removed by the purchaser at his/her expense within ten (10) days of sale and, if not so removed will incur storage fees. Unpaid lots may be sold by the Auction House. The Auction House may pursue the purchaser(s) through civil prosecution and/ or bar the purchaser(s) from participating, directly or indirectly, as a bidder or purchaser in any future sale or sales. The Auction House will not be responsible for any loss, damage, theft, or otherwise responsible for any goods left in the Auction House's possession after ten (l0) days. If the foregoing conditions or any applicable provisions of law are not complied with, in addition to other remedies available to the Auction House and the Consignor (including without limitation the right to hold the purchaser(s) liable for the bid price) the Auction House, at its option, may either cancel the sale, retaining as liquidated damages all payments made by the purchaser(s), or resell the property. In such event, the purchaser(s) shall remain liable for any deficiency in the original purchase price and will also be responsible for all costs, including warehousing, the expense of the ultimate sale, and the Auction House's commission at its regular rates together with all related and incidental charges, including legal fees. Payment is a precondition to removal. Payment by US buyers shall be by cash (at the auction venue only), credit card, check, money order, certified check or similar bank draft, or any other method approved by the Auction House. Buyers outside of the US must pay by money order or wire transfer unless they have made prior arrangements with the Auction House. Checks will not be deemed to constitute payment until cleared. The Auction House will charge interest of two percent (2%) per month on any balance remaining thirty (30) days after the day of sale. Any exceptions must be made upon the Auction House's written approval of credit prior to sale.

Unless the lot is advertised and announced as "without reserve", each lot is subject to a reserve price below which the lot will not be sold. Where the Consignor is indebted to the Auction House, the Auction House may have an interest in the offered lots and the proceeds there from other than the Broker's Commissions, and all sales are subject to any such interest.

Automatic Bidding or Absentee Bids

When bidding through the Se-Lectables app you may enter your highest bid at any time the auction is open for bidding. Your bids will then be entered automatically and incrementally against other bids for the same lot. The app will continue to bid for you until you either win the lot or are outbid.

Any other pre-sale, aka absentee bids, must be left in writing with the Auction House prior to commencement of offer of the first lot of any sale. The Auction House's copy of any such bid shall conclusively be deemed to be the sole evidence of same, and the Auction House shall not be held responsible for any failure to execute any pre-sale bid that is left in writing.

Buyer’s Premium
A buyer's premium will be added to the successful bid price and is payable by the purchaser as part of the total purchase price. The buyer's premium is 15% of the successful bid price for all payments made by cash, check, bank draft or wire transfer. The buyer’s premium is 18% for all payments made by credit card.

Auction House Partners
The Auction House may engage the services of Live Auctioneers to expand its outreach for competitive bidding. Please proceed to www.liveauctioneers.com for all necessary information on how to bid and buy online using these systems. Other bidding platforms may also be used. An additional buyers premium may apply. The user of Live Auctioneers indemnifies and holds the Auction House and its Consignors harmless against any claim arising out of or resulting from use of Live Auctioneers including all losses, damages, liabilities, and all fees (including attorney's fees,) costs, and expenses incurred in connection with any claim. Under no circumstances, including, but not limited to, negligence, shall the Auction House and its Consignors be liable for lost profits or any special, incidental, or consequential damages that result from the use of, or the inability to use, this site.

Method of Payment
Clients are required to provide valid credit card information on registration, for live or online bidding. The Auction House will treat this credit card as the method of payment for all outstanding invoices unless the client has made prior arrangements with and received approval from the Auction House for an alternate method of payment. We will charge this credit card for any winning bid at the conclusion of the auction. If the credit card purchase is declined at that time, the Auction House reserves the right to begin collection proceedings, up to and including legal action. Purchaser will be liable for all costs associated with those proceedings. By registering, in person or online, you hereby acknowledge and agree to the preceding. 

Sales Tax
Unless exempted by law from the payment thereof, the purchaser will be required to pay any and all applicable state and/or local sales taxes, Customs Duties or V A Ts. Deliveries to be made outside the state where a sale is conducted may therefore be subject to a corresponding or compensating tax in another state. It is the sole responsibility of any buyer to comply with the laws of their state or country. Sales within the State of Florida will incur the Florida Sales Tax of 6.5%. Businesses are excluded from sales tax when providing a copy of their current Florida resale tax certificate.


Pick Up, Shipping or Storage

Lots won by successful bidders who have arranged for packing and shipment through the Auction House's shipper will be shipped within ten (10) days of receipt of payment. (items cannot be shipped before money clears the bank. This may cause delays for those paying by personal check).

After settling your account, you may pick up your purchases at the auction location or storage facility or arrange to have them shipped. All purchases should be picked up or shipped within ten business days of the auction date. After that time, your property will be subject to handling and storage fees specified in the Pick Up, Shipping or Storage section of these Terms and Conditions. The Auction House has provided for shipping, pick up or storage through On Time Moving and Storage who will provide safe packing and worldwide shipping at the buyer’s expense. A buyer's premium will be added to the successful bid price and is payable by the purchaser as part of the total purchase price. The buyer's premium is 15% of the successful bid price for all payments made by cash, check, bank draft or wire transfer. The buyers premium is 18% for all payments made by credit card. The buyers premium remains the same for bidding on the Se-Lectables Auction House App or live in person. Single or combined purchases above $40,000 will receive a 3% discount on the buyers premium.  You may pay by cash, credit card, check, money order or wire transfer. We accept Visa, MasterCard, Discover and American Express (subject to certain restrictions and fees). Wire transfers must be paid in USD only and will incur a wire transfer fee. If you pay by check, your purchase will be released upon notice that your check has cleared. You may pay for your purchase immediately after the auction by going to the cashier on site, otherwise an invoice will be emailed to you following the sale. The Auction House must receive payment in full within 10 days of the sale. Payments not received within 10 days will incur a storage fee, plus a 2% per month interest fee on any outstanding balance. Your credit card information, including number, expiration date and CVV number, will be required in order to register to bid; if you do not attend the auction in person, your invoice total will automatically be charged to this card unless you have made other arrangements with the Auction House before the auction.
